ZONING COMMISSION
REGULAR MEETING MINUTES
Monday, April 21, 2014 – 7:00 P.M.
Town Hall, 302 Main Street
1st floor conference room

I.      CALL TO ORDER

        Chairman Friedmann called the meeting to order at 7:00 p.m.

III.    REGULAR BUSINESS
        
  • MINUTES
The Commission reviewed the meeting minutes of March 7, 2014.

J. Heffernan was seated for G. Lewis.


  • CORRESPONDENCE
Memorandum dated April 6, 2014 from the Economic Development Commission (EDC) requesting referrals for applications located in Mariner’s Way.  The Zoning Enforcement Officer advised that she contacted the Economic Development Coordinator and that any applications in that area will be forwarded to EDC in the future.

Invitation from the CT River Gateway Commission to attend the annual CT River cruise on June 5, 2014. The Zoning Enforcement Officer will RSVP for members interested in attending.


  • IV.  WORKSHOP
             Zoning Regulations – Discuss possible amendments to outdated and conflicting regulations

The Zoning Commission continued their discussion on possible text amendments and instructed the Zoning Enforcement Officer to make further corrections, send to legal counsel for review and schedule public hearing.


  • COMMITTEE, REPRESENTATIVE & STAFF REPORTS
        The Zoning Enforcement Officer reported on the following:


  • Max’s Place, Spencer Plain/Center Road West – The ZEO updated the Commission on the status of construction.
  • LCN, a nail polish /nail product distribution company is interested in relocating their business to Custom Drive.  The ZEO discussed the details of the business and advised that a small retail salon will be opened at the site for product demonstration. The Zoning Commission agreed that the property is suitable for this use.
  • 19 Bridge Street – The ZEO reported that she brought the matter to the Zoning Board of Appeals for guidance and is reviewing the ZBA audio cassettes to assist her in making a determination on handling this enforcement matter.
  • Department of Police Services, Lynde Street – The ZEO advised that she received a request to remove 4 additional trees that were not identified for removal during the Special Exception application review. The Zoning Commission advised the ZEO to handle the matter administratively as long as the trees identified for removal are declared diseased or rotten. The ZEO can make this determination however the Commission encouraged the ZEO to obtain assistance from the Tree Warden. Any trees removed should be replaced by trees elsewhere on the site that are a minimum of 3 ½ diameter at breast height and 6’ in height at the time of planting.
  • 1395 Boston Post Road – The Tea Kettle Restaurant is interested in locating to the former Tiberio’s Restaurant location to serve breakfast and lunch. No changes to the number of seats or to general operations. The Zoning Commission instructed the ZEO to handle the matter administratively (SPEX use to SPEX use).
  • The ZEO updated the Commission on recent administrative applications and enforcement activities.

VI.     ADJOURNMENT

        Chairman Friedmann adjourned the meeting at 8:15 p.m to the next regularly scheduled meeting of the Zoning Commission which will take place on Monday, May 5, 2014 at 7:00 p.m., Town Hall, 1st Floor Conference Room, 302 Main Street, Old Saybrook.
